It is certain that the election will be moved, preparations will be made in February will be discussed here in details about this news one Nepal. It is almost certain that there will be no representative and provincial assembly elections on the date proposed by the Election Commission. On June 22, the Election Commission had suggested to the government to hold the elections for the Provincial Assembly and the House of Representatives in one phase on November 2.
The officials of the commission met with Prime Minister Sher Bahadur Deuba and suggested to fix the election date so that it can be completed in one step. The commission suggested to set the date of election 120 days in advance.
Also, the commission advised to fix the date of the election by concluding that the term of office of the members of the current House of Representatives and Provincial Assembly completed in 074 will be completed on the 22nd of December.
Elections were held in two phases on 10 and 21 December 2007. But there is no clear legal provision as to when the five-year tenure of the elected House of Representatives and Provincial Assembly will be counted.
The commission suggested the government to set the date of the next election based on the date of the first election. The Commission says that it is practical and indisputable to calculate the term of office of the members of the House of Representatives and Provincial Assembly based on the first elected date as it seems that different dates should be considered when calculating the elected date of each member.
However, a minister informed Ratopati that the possibility of the general election being held in the first week of November has ended since the government did not set the date for the election even until the 10th of July. According to the minister, the discussion within the alliance has progressed to hold elections in the first week of February. A few days ago, Chairman of Maoist Center Pushpa Kamal Dahal Prachanda, Chairman of United Socialists Madhav Nepal and Federal Council Chairman of Jaspa Baburam Bhattarai also requested Prime Minister Deuba to postpone the elections to February.
According to Baluwatar sources, they met Prime Minister Deuba a few days ago and suggested that it would be appropriate to hold elections in the first week of February. Maoist Center, Integrated Socialists, Jaspa Baburam Party and National Unity Campaign led by Bamdev Gautam are preparing to make the Socialist Center.
They argued that by merging four parties, there would be insufficient time to go to the elections in November. However, a Congress official said that Prime Minister Deuba is in favor of moving the elections to November. In the discussion with the Congress leaders, there was a debate about February elections. In that discussion, Deuba was of the position that the election should not be postponed.
During the discussion with the officials of the commission, Prime Minister Deuba said that the date of the election will be fixed around the date suggested by the commission. But a Congress official says that the announcement of the election date has been delayed pending the Supreme Court’s decision regarding the passage of some bills by the Parliament and the appointment of Constitutional Commission officials.
Preparations are underway to pass laws such as citizenship. It is said that the matter of law was finished before the date of the election was announced,” a Congress official said, “Behind the government’s failure to announce the date of the election, it seems that the decision of the Supreme Court on the appointment of the constitutional commission officials made by the KP Oli-led government is also waiting. There is a hearing in the Supreme Court about this on Wednesday.
The government is hoping that the appointment made by the Oli government will be annulled by the Supreme Court. The Deuba government is preparing to appoint constitutional commission officials before the election if the Supreme Court cancels the appointments made by the Oli government.
In the beginning, Prime Minister Deuba registered a bill in the Parliament to amend the Act, 2066 relating to the Constitutional Council (Work, Duties, Rights and Procedures). In the bill related to the Constitutional Council, there was a provision that if the majority of the members were present, the quorum would be reached for the meeting.
“If the chairman and at least 50 percent of the current members are present, the quorum for the meeting of the council is considered to be reached” was mentioned in section 2 of (3) of the amendment bill. Article 284 of the Constitution provides for the Constitutional Council. It is mentioned that there will be a 6-member Constitutional Council to recommend the appointment of the Chief Justice and the heads and officers of constitutional bodies.
The Prime Minister remains the President, while the Chief Justice, the Speaker, the Speaker of the National Assembly, the Leader of the Opposition and the Deputy Speaker remain members. It was said that the decision of each subject presented in the meeting of the 6-member council will be based on consensus, if there is no consensus, the decision (recommendation of appointment to various constitutional bodies) can be made by the majority of the council president and fifty percent of the members currently in office.
Since the leader of the opposition party and the Speaker of the National Assembly were not favorable to the coalition government, the government tried to take that route. But after strong opposition to it, the government held the election of the Deputy Speaker on June 31 and stopped the bill.
Since Congress MP Pushpa Bhusal was elected as the Deputy Speaker, the ruling party will reach a quorum without the presence of the opposition in the Constitutional Council meeting. It is not hidden that the announcement of the election date was delayed when the government was worried about it.
Although Prime Minister Deuba is in favor of holding the election in November, the date has not been announced due to the greed of appointment to the Constitutional Commission and pressure from the leaders of the ruling party.
The Congress official said, ‘Many people are interested in shifting the elections to February within the alliance. They complained that the Election Commission had proposed the date of the general election on November 2. The Election Commission, knowing too much, said that it cannot be held in November,” said another official of the Congress, saying that the election would be held in the first week of February.
He said, “The elections will be held in the first week of February. Because we don’t have 120 days to hold elections on November 4. The election has not been announced yet. Only when the election is announced on June 10, it will be 120 days until November 10.
“When the election is announced within a week, it will reach the middle of November,” he said, “to ensure that the local level and state union elections are not six months away, the target was 2nd of November.” As it will not be completed, there is a possibility that the election will be announced for the first week of February.
On the other hand, UML parliamentary party deputy leader Subashchandra Nemwang also said that rumors of shifting the election to February have started to be heard. The government will announce the election after the recommendation of the Election Commission. The commission has already said,” he said in an interview with Ratopati, ‘but the election will be announced on a certain date, but now the last four days have passed, the election is not yet finalized. Rumors are being heard today, there is a situation of moving it until February.
He says that there are doubts about the coalition government holding elections. He said, “We have not seen that our friends in the government are very eager about the election.”
